Brief introduction

Nature person, legal person and other entities should file trademark application as requests by Chinese Trademark Law, to protect its goods/service brand in China. There are 45 classes according International Classification, 34 classes for goods, and 11 classes for service. 

Procedure

1、Checking the word/design name；

2、Filing documents；

3、Decision of Acceptance for application；

4、Trademark Office examination；

5、Publication；

6、Registration Certificate.

Material requirement

1、Applicant 

（1）nature applicant: passport copy file and signed, and private license; 

（2）company applicant: company license copy file with stamp.

2、List of goods/services for which a trademark application should be filed.Trademark designation in a WORD or JPEG format.

3、Applications and signed.

4、Power of Attorney executed on behalf of the applicant. This document should be signed by a authorized person. 

Please find below approximate time frames for trademark prosecution in China:

•  the Decision of Acceptance of application for Substantial Examination is issued within 1.5-2 months form the filing date;
•  the Official Action is issued within about 12-15 months from the date of filing of application;

The whole process of registration(smooth procedue) usually takes about 13-14 months.
